Frequently Asked Questions
Quick answers to common questions
General
What is a notary public?
A notary public is an official commissioned by the state to serve as an impartial witness to the signing of important documents. Notaries verify the identity of signers, ensure they are signing willingly and are aware of the document’s contents, and deter fraud by providing an official certification of the signature.
What do I need to bring to get something notarized?
You need:
- Valid government-issued photo ID - Driver’s license, passport, state ID, or military ID
- The document to be notarized - Unsigned (you’ll sign in front of the notary)
- All signers present - Everyone who needs to sign must appear in person with their own ID
- Payment - Cash, card, or agreed-upon payment method
Do not sign the document beforehand - you must sign in the presence of the notary.
Can you notarize documents for family members?
No. Florida law prohibits notaries from notarizing documents in which they have a financial interest or for immediate family members (spouse, parents, children, siblings). This ensures impartiality and prevents conflicts of interest.
What documents can't you notarize?
Notaries cannot:
- Notarize incomplete documents
- Notarize documents where the signer cannot be identified
- Notarize for someone who appears coerced or lacks understanding
- Notarize documents in which they have a personal interest
- Provide legal advice or draft legal documents (unless also an attorney)
- Certify copies of birth certificates, marriage certificates, or other vital records (these require certified copies from the issuing agency)
When in doubt, contact us and we’ll let you know if your document can be notarized.
